General terms and conditions and customer information

GeneralThe following General Terms and Conditions apply to the business relationship between end customers and DIVIKOM, s.r.o., Dolmenska 772, 25241 Dolni Brezany, Czech Republic and are accepted in full by both parties upon invoicing/payment.

AssortmentFrom the current catalogue and our online shops at www.divikom.eu. We reserve the right to make technical and other changes within reasonable limits. Our product presentations on the Internet are non-binding and do not constitute a binding offer to conclude a contract.

PricesPrices in the price list are net prices before discount and do not include VAT. If the buyer does not have a valid EU VAT number on the day of payment, we will also charge the statutory VAT. The list prices in EUR according to the current price list shall apply.

Minimum order amountThe minimum order amount is EUR 250 excluding VAT.

VAT deductionIf the buyer is authorised to deduct VAT on the day of the order and has a valid EU VAT number, we will of course issue the invoice net.

Terms of deliveryDelivery is usually DAP Incoterms (delivered at place), without unloading and carrying. By additional agreement, we can carry out the delivery including carrying and assembly.

Transport costsTransport costs are determined separately and shown on the invoice and are calculated individually according to volume, weight and distance to the destination.

Terms of paymentFor first orders: 100% prepayment by bank transfer before delivery is required. Alternatively for first order: 60% down payment before production and 40% prepayment by bank transfer before delivery.

Payments must be made in euros (EUR). The relevant bank details will be provided when the pro forma invoice is issued. 

AssemblyAssembly costs are not included in the prices listed. Assembly is possible by arrangement.

Delivery timesDelivery times are generally between 4 and 6 weeks after receipt of payment or down payment or, in the case of purchase contracts, after receipt of the binding order. Deviations or delays will be notified in good time. With the express delivery programme, delivery is usually within one week.

ComplaintsThe buyer is required to check the goods immediately upon delivery for any shortages or damage and to have these immediately certified by the driver on the consignment note. Hidden defects must be reported to us within 5 days of receipt of the goods. Damaged or rejected goods must be returned - by agreement - and will be repaired or replaced as soon as possible. All complaints must be made in writing. Shipping and transport costs for export deliveries will not be reimbursed in the event of complaints.

Exchange/revocationArticles that are manufactured to customer order or those that are not available from stock, as well as customised products, are excluded from exchange/cancellation.

We sell exclusively to commercial customers and customers under public law. It is not possible to take back the delivered goods within the meaning of the right of cancellation for private customers. Our general terms and conditions apply.

GuaranteeIn principle, we grant a warranty period of 24 months from the date of delivery on all export articles purchased from us in accordance with EU Directive 1999/44/EC.
